C\u1ea7n gi\u1ea3i th\u00edch \u201cH\u1ee3p \u0111\u1ed3ng t\u00edn d\u1ee5ng\u201d l\u00e0 g\u00ec, khi m\u00e0 n\u00f3 ch\u1ec9 \u0111\u01b0\u1ee3c quy \u0111\u1ecbnh trong c\u00e1c v\u0103n b\u1ea3n \u0111\u00e3 h\u1ebf hi\u1ec7u l\u1ef1c nh\u01b0 Lu\u1eadt C\u00e1c t\u1ed5 ch\u1ee9c t\u00edn d\u1ee5ng n\u0103m 1997, Quy\u1ebft \u0111\u1ecbnh s\u1ed1 1627\/2001\/Q\u0110-NHNN, m\u00e0 kh\u00f4ng c\u00f2n \u0111\u01b0\u1ee3c quy \u0111\u1ecbnh trong c\u00e1c v\u0103n b\u1ea3n d\u01b0\u1edbi \u0111\u00e2y:<\/p>\n<ul>\n<li>Lu\u1eadt C\u00e1c t\u1ed5 ch\u1ee9c t\u00edn d\u1ee5ng n\u0103m 2010;<\/li>\n<li>Th\u00f4ng t\u01b0 39\/2016\/TT-NHNN ng\u00e0y 30-12-2016 c\u1ee7a Th\u1ed1ng \u0111\u1ed1c Ng\u00e2n h\u00e0ng Nh\u00e0 n\u01b0\u1edbc \u201cQuy \u0111\u1ecbnh v\u1ec1 ho\u1ea1t \u0111\u1ed9ng cho vay c\u1ee7a t\u1ed5 ch\u1ee9c t\u00edn d\u1ee5ng, chi nh\u00e1nh ng\u00e2n h\u00e0ng n\u01b0\u1edbc ngo\u00e0i \u0111\u1ed1i v\u1edbi kh\u00e1ch h\u00e0ng\u201d;<\/li>\n<li>Th\u00f4ng t\u01b0 s\u1ed1 43\/2016\/TT-NHNN ng\u00e0y 30-12-2016 c\u1ee7a Th\u1ed1ng \u0111\u1ed1c Ng\u00e2n h\u00e0ng Nh\u00e0 n\u01b0\u1edbc \u201cQuy \u0111\u1ecbnh cho vay ti\u00eau d\u00f9ng c\u1ee7a c\u00f4ng ty t\u00e0i ch\u00ednh\u201d.<\/li>\n<\/ul>\n<p>1.2. V\u00e0 h\u1ee3p \u0111\u1ed3ng cho vay c\u1ee7a Ng\u00e2n h\u00e0ng ph\u00e1t tri\u1ec3n v\u00e0 Qu\u1ef9 \u0111\u1ea7u t\u01b0 ph\u00e1t tri\u1ec3n \u0111\u1ecba ph\u01b0\u01a1ng c\u00f3 ph\u1ea3i l\u00e0 H\u1ee3p \u0111\u1ed3ng t\u00edn d\u1ee5ng hay kh\u00f4ng?<\/p>\n<p><strong><em>2. \u0110i\u1ec1u v\u1ec1 \u201cX\u00e1c \u0111\u1ecbnh l\u00e3i, l\u00e3i su\u1ea5t trong h\u1ee3p \u0111\u1ed3ng vay t\u00e0i s\u1ea3n kh\u00f4ng ph\u1ea3i l\u00e0 h\u1ee3p \u0111\u1ed3ng t\u00edn d\u1ee5ng thu\u1ed9c tr\u01b0\u1eddng h\u1ee3p \u00e1p d\u1ee5ng B\u1ed9 lu\u1eadt D\u00e2n s\u1ef1 n\u0103m 1995\u201d:<\/em><\/strong><\/p>\n<p><em>2.1. Kho\u1ea3n 1<\/em> <em>h\u01b0\u1edbng d\u1eabn: H\u1ee3p \u0111\u1ed3ng vay t\u00e0i s\u1ea3n x\u00e1c l\u1eadp tr\u01b0\u1edbc ng\u00e0y 01-01-2006<\/em> <em>\u201c<\/em><em>theo l\u00e3i su\u1ea5t ti\u1ebft ki\u1ec7m c\u00f3 k\u1ef3 h\u1ea1n do Ng\u00e2n h\u00e0ng Nh\u00e0 n\u01b0\u1edbc quy \u0111\u1ecbnh t\u1ea1i th\u1eddi \u0111i\u1ec3m tr\u1ea3 n\u1ee3<\/em><em>\u201d =&gt; b\u1ebf t\u1eafc, v\u00ec NHNN \u0111\u00e3 b\u1ecf quy \u0111\u1ecbnh v\u1ec1 l\u00e3i su\u1ea5t ti\u1ebft ki\u1ec7m t\u1eeb 01-01-1996.<\/em><\/p>\n<p>2.2. Kho\u1ea3n 2 <em>h\u01b0\u1edbng d\u1eabn<\/em>: L\u00e3i tr\u00ean n\u1ee3 g\u1ed1c trong h\u1ea1n ch\u01b0a tr\u1ea3 theo l\u00e3i su\u1ea5t th\u1ecfa thu\u1eadn \u201c<em>nh\u01b0ng kh\u00f4ng \u0111\u01b0\u1ee3c v\u01b0\u1ee3t qu\u00e1 50% c\u1ee7a l\u00e3i su\u1ea5t cao nh\u1ea5t do Ng\u00e2n h\u00e0ng nh\u00e0 n\u01b0\u1edbc quy \u0111\u1ecbnh \u0111\u1ed1i v\u1edbi lo\u1ea1i cho vay t\u01b0\u01a1ng \u1ee9ng t\u1ea1i th\u1eddi \u0111i\u1ec3m x\u00e1c l\u1eadp h\u1ee3p \u0111\u1ed3ng t\u01b0\u01a1ng \u1ee9ng v\u1edbi th\u1eddi gian vay ch\u01b0a tr\u1ea3 l\u00e3i<\/em>\u201d: =&gt; C\u00f3 th\u1ec3 b\u1ebf t\u1eafc, v\u00ec NHNN kh\u00f4ng c\u00f2n quy \u0111\u1ecbnh l\u00e3i su\u1ea5t cao nh\u1ea5t t\u1eeb ng\u00e0y 01-02-2009.<\/p>\n<p><strong>3. \u0110i\u1ec1u 5 v\u1ec1 \u201cX\u00e1c \u0111\u1ecbnh l\u00e3i, l\u00e3i su\u1ea5t trong h\u1ee3p \u0111\u1ed3ng vay t\u00e0i s\u1ea3n kh\u00f4ng ph\u1ea3i l\u00e0 h\u1ee3p \u0111\u1ed3ng t\u00edn d\u1ee5ng thu\u1ed9c tr\u01b0\u1eddng h\u1ee3p \u00e1p d\u1ee5ng B\u1ed9 lu\u1eadt D\u00e2n s\u1ef1 n\u0103m 2015\u201d:<\/strong><\/p>\n<p><em>Kho\u1ea3n 2.c h\u01b0\u1edbng d\u1eabn<\/em>: \u201c<em>Ti\u1ec1n l\u00e3i tr\u00ean n\u1ee3 g\u1ed1c qu\u00e1 h\u1ea1n ch\u01b0a tr\u1ea3 = (n\u1ee3 g\u1ed1c qu\u00e1 h\u1ea1n ch\u01b0a tr\u1ea3) x (l\u00e3i su\u1ea5t do c\u00e1c b\u00ean th\u1ecfa thu\u1eadn ho\u1eb7c 150% l\u00e3i su\u1ea5t vay do c\u00e1c b\u00ean th\u1ecfa thu\u1eadn) x (th\u1eddi gian ch\u1eadm tr\u1ea3 n\u1ee3 g\u1ed1c)<\/em>\u201d. =&gt; C\u1ea7n kh\u1eb3ng \u0111\u1ecbnh r\u00f5 th\u1ecfa thu\u1eadn kh\u00f4ng qu\u00e1 150%, n\u1ebfu kh\u00f4ng s\u1ebd r\u1ea5t v\u00f4 l\u00fd n\u1ebfu th\u1ecfa thu\u1eadn c\u1ea3 ngh\u00ecn %\/n\u0103m, h\u1ee3p ph\u00e1p h\u00f3a l\u00e1ch lu\u1eadt cho vay l\u00e3i n\u1eb7ng.<\/p>\n<p><strong>4. \u0110i\u1ec1u 7 v\u1ec1 \u201c\u00c1p d\u1ee5ng ph\u00e1p lu\u1eadt v\u1ec1 l\u00e3i, l\u00e3i su\u1ea5t trong h\u1ee3p \u0111\u1ed3ng t\u00edn d\u1ee5ng\u201d:<\/strong><\/p>\n<p>Sai quy \u0111\u1ecbnh c\u1ee7a B\u1ed9 lu\u1eadt D\u00e2n s\u1ef1 2015, nh\u01b0ng OK.<\/p>\n<p><strong>5. \u0110i\u1ec1u 11 v\u1ec1 \u201cX\u00e1c \u0111\u1ecbnh l\u00e3i su\u1ea5t trung b\u00ecnh quy \u0111\u1ecbnh t\u1ea1i \u0110i\u1ec1u 306 c\u1ee7a Lu\u1eadt Th\u01b0\u01a1ng m\u1ea1i n\u0103m 2005\u201d:<\/strong><\/p>\n<p>5.1. C\u1ea7n x\u00e1c \u0111\u1ecbnh r\u00f5 l\u00e0 l\u1ea5y l\u00e3i su\u1ea5t c\u1ee7a Chi nh\u00e1nh ho\u1eb7c Ph\u00f2ng giao d\u1ecbch ch\u1ee9 kh\u00f4ng ph\u1ea3i c\u1ee7a ng\u00e2n h\u00e0ng.<\/p>\n<p>5.2. N\u00eau 3 ng\u00e2n h\u00e0ng th\u01b0\u01a1ng m\u1ea1i l\u00e0 \u0111\u1ee7, kh\u00f4ng n\u00ean \u0111\u1ec3 \u0111o\u1ea1n m\u1edf ngo\u1eb7c \u0111\u01a1n nh\u01b0 sau \u201c(<em>Ng\u00e2n h\u00e0ng th\u01b0\u01a1ng m\u1ea1i c\u1ed5 ph\u1ea7n Ngo\u1ea1i th\u01b0\u01a1ng Vi\u1ec7t Nam, Ng\u00e2n h\u00e0ng th\u01b0\u01a1ng m\u1ea1i c\u1ed5 ph\u1ea7n C\u00f4ng th\u01b0\u01a1ng Vi\u1ec7t Nam, Ng\u00e2n h\u00e0ng N\u00f4ng nghi\u1ec7p v\u00e0 ph\u00e1t tri\u1ec3n n\u00f4ng th\u00f4n Vi\u1ec7t Nam,&#8230;)<\/em>\u201d.<\/p>\n<p><strong>6. \u0110i\u1ec1u 13 v\u1ec1 \u201cQuy\u1ebft \u0111\u1ecbnh l\u00e3i, l\u00e3i su\u1ea5t trong b\u1ea3n \u00e1n, quy\u1ebft \u0111\u1ecbnh c\u1ee7a T\u00f2a \u00e1n\u201d:<\/strong><\/p>\n<p>6.1. Kho\u1ea3n 1 h\u01b0\u1edbng d\u1eabn: \u201c<em>\u0110\u1ed1i v\u1edbi tr\u01b0\u1eddng h\u1ee3p ch\u1eadm th\u1ef1c hi\u1ec7n ngh\u0129a v\u1ee5 trong h\u1ee3p \u0111\u1ed3ng m\u00e0 c\u00e1c b\u00ean c\u00f3 th\u1ecfa thu\u1eadn v\u1ec1 vi\u1ec7c tr\u1ea3 l\u00e3i th\u00ec quy\u1ebft \u0111\u1ecbnh k\u1ec3 t\u1eeb ng\u00e0y ti\u1ebfp theo c\u1ee7a ng\u00e0y x\u00e9t x\u1eed s\u01a1 th\u1ea9m cho \u0111\u1ebfn khi thi h\u00e0nh \u00e1n xong, b\u00ean ph\u1ea3i thi h\u00e0nh \u00e1n c\u00f2n ph\u1ea3i ch\u1ecbu kho\u1ea3n ti\u1ec1n l\u00e3i c\u1ee7a s\u1ed1 ti\u1ec1n c\u00f2n ph\u1ea3i thi h\u00e0nh \u00e1n theo m\u1ee9c l\u00e3i su\u1ea5t hai b\u00ean th\u1ecfa thu\u1eadn trong h\u1ee3p \u0111\u1ed3ng nh\u01b0ng ph\u1ea3i ph\u00f9 h\u1ee3p v\u1edbi quy \u0111\u1ecbnh c\u1ee7a ph\u00e1p lu\u1eadt<\/em>\u201d l\u00e0 sai c\u01a1 b\u1ea3n, c\u1ea7n ph\u1ea3i b\u1ecf, v\u00ec T\u00f2a \u0111\u00e3 tuy\u00ean \u00e1n th\u00ec kh\u00f4ng c\u00f2n t\u1ed3n t\u1ea1i b\u1ea5t c\u1ee9 th\u1ecfa thu\u1eadn n\u00e0o n\u00f3i chung, v\u1ec1 l\u00e3i su\u1ea5t n\u00f3i ri\u00eang.<\/p>\n<p>6.2. Ngo\u00e0i ra, \u0111i\u1ec1u n\u00e0y s\u1ebd ti\u1ebfp t\u1ee5c d\u1eabn \u0111\u1ebfn b\u1ea5t h\u1ee3p l\u00fd, kho\u1ea3n cho vay l\u00e3i su\u1ea5t 5%\/n\u0103m, c\u00f3 th\u1ec3 ch\u1ec9 \u0111\u01b0\u1ee3c t\u00ednh l\u00e3i ch\u1eadm thi h\u00e0nh \u00e1n 7,5%\/n\u0103m, trong khi kho\u1ea3n cho vay 50%\/n\u0103m th\u00ec l\u1ea1i \u0111\u01b0\u1ee3c t\u00ednh l\u00e3i ch\u1eadm thi h\u00e0nh \u00e1n 75%. Ngo\u00e0i ra c\u00e0ng nh\u00e2n l\u00ean s\u1ef1 b\u1ea5t h\u1ee3p l\u00fd theo h\u01b0\u1edbng d\u1eabn t\u1ea1i \u0110i\u1ec1u kho\u1ea3n 5.2.c.<\/p>\n<p><strong><em>7. K\u1ef9 thu\u1eadt so\u1ea1n th\u1ea3o:<\/em><\/strong><\/p>\n<p>7.1. Trong Th\u00f4ng t\u01b0 \u0111\u01b0\u1ee3c k\u1ebft c\u1ea5u theo \u0111i\u1ec1u, th\u00ec m\u1ecdi n\u1ed9i dung \u0111\u1ec1u ph\u1ea3i n\u1eb1m trong \u0111i\u1ec1u, trong \u0111i\u1ec1u \u0111\u01b0\u1ee3c b\u1ed1 c\u1ee5c theo kho\u1ea3n th\u00ec m\u1ecdi n\u1ed9i dung ph\u1ea3i n\u1eb1m trong kho\u1ea3n.<\/p>\n<p>7.2.
