Theo quy \u0111\u1ecbnh t\u1ea1i kho\u1ea3n 3, \u0110i\u1ec1u 3, Lu\u1eadt DN, tr\u01b0\u1eddng h\u1ee3p \u0111i\u1ec1u \u01b0\u1edbc qu\u1ed1c t\u1ebf m\u00e0 CHXHCN Vi\u1ec7t Nam l\u00e0 th\u00e0nh vi\u00ean c\u00f3 quy \u0111\u1ecbnh kh\u00e1c v\u1edbi quy \u0111\u1ecbnh c\u1ee7a Lu\u1eadt n\u00e0y th\u00ec \u00e1p d\u1ee5ng theo quy \u0111\u1ecbnh c\u1ee7a \u0111i\u1ec1u \u01b0\u1edbc qu\u1ed1c t\u1ebf. Qu\u1ed1c h\u1ed9i Vi\u1ec7t Nam \u0111\u00e3 ban h\u00e0nh Ngh\u1ecb quy\u1ebft 71\/2006\/NQ-QH11 \u0111\u1ec3 ph\u00ea chu\u1ea9n vi\u1ec7c Vi\u1ec7t Nam gia nh\u1eadp WTO, trong \u0111\u00f3 quy \u0111\u1ecbnh, c\u00f4ng ty TNHH, CTCP \u0111\u01b0\u1ee3c quy\u1ec1n quy \u0111\u1ecbnh trong \u0110i\u1ec1u l\u1ec7 c\u00f4ng ty c\u00e1c n\u1ed9i dung sau: t\u1ef7 l\u1ec7 \u0111a s\u1ed1 phi\u1ebfu c\u1ea7n thi\u1ebft (k\u1ec3 c\u1ea3 t\u1ef7 l\u1ec7 \u0111a s\u1ed1 51%) \u0111\u1ec3 th\u00f4ng qua c\u00e1c quy\u1ebft \u0111\u1ecbnh c\u1ee7a H\u0110TV, \u0110HC\u0110. Trong khi Lu\u1eadt DN l\u1ea1i quy \u0111\u1ecbnh t\u1ef7 l\u1ec7 t\u1ed1i thi\u1ec3u c\u1ea7n c\u00f3 \u0111\u1ec3 th\u00f4ng qua quy\u1ebft \u0111\u1ecbnh c\u1ee7a H\u0110TV, \u0110HC\u0110 l\u00e0 65%. \u0110i\u1ec1u n\u00e0y m\u00e2u thu\u1eabn v\u1edbi cam k\u1ebft WTO c\u1ee7a Vi\u1ec7t Nam.<\/p>\n

Theo lu\u1eadt gia Cao B\u00e1 Kho\u00e1t, ph\u1ea3i \u0111\u1ecbnh r\u00f5 ph\u1ea1m vi \u00e1p d\u1ee5ng cam k\u1ebft WTO \u0111\u1ebfn \u0111\u00e2u. Theo \u00f4ng Kho\u00e1t, c\u00e1c DN li\u00ean doanh theo c\u00e1c cam k\u1ebft trong Bi\u1ec3u cam k\u1ebft d\u1ecbch v\u1ee5 v\u00e0 c\u00e1c li\u00ean doanh \u0111\u00e3 th\u00e0nh l\u1eadp tr\u01b0\u1edbc ng\u00e0y Lu\u1eadt DN c\u00f3 hi\u1ec7u l\u1ef1c \u0111\u01b0\u01a1ng nhi\u00ean c\u00f3 quy\u1ec1n \u00e1p d\u1ee5ng Ngh\u1ecb quy\u1ebft 71\/2006 c\u1ee7a Qu\u1ed1c h\u1ed9i. Cam k\u1ebft WTO l\u00e0 s\u1ef1 tho\u1ea3 hi\u1ec7p gi\u1eefa Vi\u1ec7t Nam v\u1edbi c\u00e1c b\u00ean \u0111\u00e0m ph\u00e1n, trong \u0111\u00f3 Lu\u1eadt DN \u0111\u00e3 nh\u01b0\u1ee3ng b\u1ed9 c\u00e1c nh\u00e0 \u0111\u1ea7u t\u01b0 n\u01b0\u1edbc ngo\u00e0i khi cho ph\u00e9p c\u00e1c b\u00ean li\u00ean doanh \u0111\u01b0\u1ee3c quy\u1ec1n tho\u1ea3 thu\u1eadn t\u1ef7 l\u1ec7 t\u1ed1i thi\u1ec3u 51% thay v\u00ec 65% nh\u01b0 quy \u0111\u1ecbnh c\u1ee7a Lu\u1eadt DN, n\u00ean ch\u1ec9 c\u00f3 c\u00e1c DN li\u00ean doanh m\u1edbi c\u00f3 quy\u1ec1n h\u01b0\u1edfng s\u1ef1 nh\u01b0\u1ee3ng b\u1ed9 n\u00e0y, c\u00e1c DN kh\u00e1c v\u1eabn ph\u1ea3i tu\u00e2n th\u1ee7 quy \u0111\u1ecbnh c\u1ee7a Lu\u1eadt DN.<\/p>\n

Tuy nhi\u00ean, theo lu\u1eadt gia Kho\u00e1t, n\u1ebfu ch\u1ec9 c\u00f3 DN li\u00ean doanh c\u00f3 quy\u1ec1n \u00e1p d\u1ee5ng Ngh\u1ecb quy\u1ebft 71 th\u00ec nhi\u1ec1u nguy\u00ean t\u1eafc c\u01a1 b\u1ea3n c\u1ee7a WTO v\u00e0 ph\u00e1p lu\u1eadt Vi\u1ec7t Nam b\u1ecb vi ph\u1ea1m. \u0110\u00f3 l\u00e0 nguy\u00ean t\u1eafc b\u00ecnh \u0111\u1eb3ng gi\u1eefa c\u00e1c ch\u1ee7 th\u1ec3 kinh doanh trong ph\u00e1p lu\u1eadt Vi\u1ec7t Nam, nguy\u00ean t\u1eafc kh\u00f4ng ph\u00e2n bi\u1ec7t \u0111\u1ed1i x\u1eed trong WTO, nguy\u00ean t\u1eafc quy\u1ec1n t\u1ef1 do tho\u1ea3 thu\u1eadn c\u1ee7a Lu\u1eadt DN.<\/p>\n

Quy \u0111\u1ecbnh n\u00e0y c\u00f3 m\u1ee5c \u0111\u00edch ban \u0111\u1ea7u l\u00e0 b\u1ea3o v\u1ec7 c\u1ed5 \u0111\u00f4ng nh\u1ecf tr\u01b0\u1edbc c\u1ed5 \u0111\u00f4ng l\u1edbn l\u00e0 Nh\u00e0 n\u01b0\u1edbc, nh\u1eb1m gi\u1ea3m thi\u1ec3u s\u1ef1 can thi\u1ec7p c\u1ee7a c\u01a1 quan h\u00e0nh ch\u00ednh v\u00e0o ho\u1ea1t \u0111\u1ed9ng c\u1ee7a DN. Tuy nhi\u00ean, quy \u0111\u1ecbnh n\u00e0y l\u1ea1i ch\u01b0a t\u00ednh \u0111\u1ebfn tr\u01b0\u1eddng h\u1ee3p c\u1ed5 \u0111\u00f4ng nh\u1ecf l\u1ee3i d\u1ee5ng quy\u1ec1n ph\u1ee7 quy\u1ebft c\u1ee7a m\u00ecnh l\u00e0m cho ho\u1ea1t \u0111\u1ed9ng c\u1ee7a DN \u0111\u00ecnh tr\u1ec7 nh\u1eb1m m\u01b0u c\u1ea7u l\u1ee3i \u00edch ri\u00eang. Th\u1eadm ch\u00ed, t\u1ea1i m\u1ed9t s\u1ed1 DN, c\u1ed5 \u0111\u00f4ng l\u1edbn ch\u1ec9 s\u1edf h\u1eefu t\u1ef7 l\u1ec7 c\u1ed5 ph\u1ea7n 36%, th\u1eadm ch\u00ed l\u00e0 26% nh\u01b0ng \u0111\u00e3 ph\u1ee7 quy\u1ebft c\u00e1c v\u1ea5n \u0111\u1ec1 quan tr\u1ecdng, th\u1eadm ch\u00ed ph\u1ee7 quy\u1ebft to\u00e0n b\u1ed9 c\u00e1c t\u1edd tr\u00ecnh c\u1ee7a H\u0110QT t\u1ea1i \u0110HC\u0110 v\u00e0 g\u00e2y kh\u00f3 kh\u0103n cho ban \u0111i\u1ec1u h\u00e0nh DN.<\/p>\n
